PRIVACY POLICY

1. Introduction.
1.1. Effective Date. The effective date of this Privacy Policy is the 19th of September 2016.

1.2. Purpose. High Five lab, LLC. (“High Five lab” or “Company”) is committed to respecting the privacy rights of users of the High Five lab website, the High Five lab service, and any software applications made available by High Five lab, such as any mobile device application High Five lab makes available (together, the “Service“). High Five lab has published this “Privacy Policy” to show its commitment to fair information practices and to the protection of privacy.

1.3. Scope. This Privacy Policy is only applicable to the Service, and not to any websites or services of third parties (“Third Party Websites“), which may have data collection, storage, and use practices and policies that differ materially from this Privacy Policy. For additional information, see Section 10 (Third Party Websites) and Section 4.5 (Third Party Cookies and Advertising).

1.4. Separate Terms of Service. By using the Service, you represent and warrant that you have also read and understood, and agree to be bound by, both this Privacy and High Five lab’s separate Terms of Service document (the “Terms of Service”), which is incorporated by reference and made part of this Privacy Policy. 1.5. No Permission Without Agreement. By using the Service, you represent and warrant that you have read and understood, and agree to the terms of, this Privacy Policy. If you do not understand or do not agree to be bound by this Privacy Policy, you must immediately cease using or accessing the Service.This Privacy Policy identifies and describes the way High Five lab LLC, a (Mycallback.co) (together with its affiliates, : “High Five lab ”,” “we,”, or “us”) regarding your use of High Five lab ’s call management solutions and other services uses and protects the information we collect about Customers and Users.
All uses of High Five lab ’s services, as well as visits to our websites, are subject to this Privacy Policy. This Policy applies to all Customers and Users. Please read our privacy policy carefully to get a clear understanding of how we collect, use, protect or otherwise handle your personally identifiable information.
Information that you provide to non-High Five lab companies is not covered by this Policy and High Five lab shall have no responsibility for protecting any such information divulged by Customer/User to a non- High Five lab company.

2.What We Collect
We collect a variety of personally identifiable information (also referred to as “personal information”) about Customers and Users in order to ensure an enjoyable user experience and seamless communications.
As used in this Policy, the terms listed below have the following meanings:
Customer — A “Customer” is anyone who uses High Five lab services. When a Customer subscribing, purchasing services for use by others, those individuals also may be considered Customers for purposes of this Policy.
UserA “User” is anyone who visits our websites.
Personal Information — “Personal Information” is information that directly identifies or reasonably can be used to identify an individual Customer or User. Examples include name, address, telephone number, e-mail address, ID, credit card number (Visa, MasterCard, or American Express) and/or PayPal account.
Website — “Website” means any page or location on the Internet, no matter what device (cell phone, lap top, PC, etc.) or protocol (http, WAP, ftp or other) is used to access the page or location. In this Policy, we use the term website other similar terms such as “Internet site,” “site,” and “web page.”

3. How We Use Personal Information
Internal Use: In general, we use personal information to serve our existing and prospective customers and to enhance and extend our customer relationships.
• We use personal information for billing purposes, to provide services or complete transactions you have requested, to anticipate and resolve problems with your services, to eliminate fraud and to create and inform you of products or services from High Five lab .
• Subject to your agreement, High Five lab uses e-mail, telemarketing and direct mail to inform you about High Five lab services we think will interest you. If you do not wish to receive these types of communications you can choose at any time not to continue receiving them by contacting us support@mycallback.co.

Despite you may choose not to receive marketing information from us, you will continue to receive invoices, customer service-related notifications and other information, related to each service you purchase or subscribe to, from us electronically or otherwise.
Customer Surveys: Periodically, you may be able to participate in our surveys to help us improve our services. Any personal information collected from you in a survey will ONLY be used internally by High Five lab and in accordance with this Policy.

4. Disclosure of Personal Information
We do not sell your personal information to anyone for any purpose, and we maintain information about you in our business records while you are a customer, or until it is no longer needed for business, tax, or legal purposes.
High Five lab may disclose your personal information if you consent to the disclosure in advance. Depending on the service, we may obtain your consent in writing or verbally.
High Five lab reserves the right to release personal information without your consent when we believe release is appropriate to do one of the following:
• Comply with the law (e.g., lawful subpoena or court order);
• Enforce or apply our agreements to sell or provide services to you;
• Bill and collect for services; or
• Protect out rights or property (e.g., to address allegations about fraudulent or unlawful activity on an High Five lab account).
We may share your personal data between our High Five lab group companies and business affiliates where it is necessary to perform the services provided to you.
In order to verify payment methods and prevent fraud, High Five lab verifies personal information, including payment information, with payment providers and fraud prevention services. If at any time you apply for a credit with us, we may perform a credit inquiry with credit reporting agencies, and such inquiry may be noted on your credit record. We may use automated decision making systems to verify payment methods, assess creditworthiness, or prevent fraud, and we may contact you requesting additional information when needed.
We may share your personal information with Third Parties only as necessary to complete a transaction or perform a service that you have requested, or to support the technical operation and maintenance of our services and of our website. We require those Third Parties to protect any personal information they may receive in a manner consistent with this Policy.
We do not provide personal information to Third Parties for the marketing of their own products and services without your consent.

5. Customer Proprietary Network Information (CPNI)
High Five lab collects and maintains certain customer proprietary network information (“CPNI”) while providing telecommunications and interconnected voice-over- Internet-protocol (“interconnected VoIP”) services to its users and customers. Your CPNI includes the types of telecommunications and interconnected VoIP services you currently purchase or subscribe to, how you use those services (for example, your calling records), and billing information related to those services. Your High Five lab telephone number, name and address do not constitute CPNI.
High Five lab does not sell, trade or otherwise share your CPNI with anyone outside of High Five lab or with anyone who is not authorized to represent us to offer our services or to perform functions on our behalf, except as the law may require or you may authorize.
We may use or disclose your CPNI for legal or regulatory reasons such as to respond to a court order, to investigate fraud, to protect our rights or property, to protect against the unlawful use of our services, or to protect other users. You have a right and we have a duty under federal law to protect the confidentiality of your CPNI.

6. Use of Cookies
High Five lab uses “cookies” to enhance your use of our website. “Cookies” are small text files placed on your computer’s hard drive by a website when you visit that website. These files identify your computer and record your preferences and other data about your visit to a website so that when you return to that site, the site operator knows who you are and can personalize your visit. For example, cookies enable a website shopping cart to function so that you only have to check out once. Consequently, cookies are often tied to the use of personally identifiable information while using our website. If you choose not to accept the use of cookies, your use of our website may be impaired.
Cookies allow us to do the following:
• Complete transactions you have requested;
• Collect information to determine which services and sections of our website are most and least popular;
• Personalize our website and make recommendations to you based on services you have used in the past; and
• Improve the ease of use of our website, sometimes in conjunction with web beacons.
We do not use cookies to store credit card information. High Five lab does, however, use cookies to store login information for customers who choose the option of storing such information on their computers.
We also use a session-based cookie to maintain continuity of navigation for you when viewing our website during a particular on-line session. After closing the browser, the session cookie simply terminates; it is not stored on your computer’s hard drive thereafter.

7. Referral Programs
If you choose to use our referral programs to refer someone to our site, we will ask you for the intended recipient’s name, email address, and phone number. High Five lab will store and use this information to send emails inviting him or her to visit the site. High Five lab stores this information for the sole purpose of sending the emails and tracking the success of our referral program. Your referral may contact us here to request that we remove this information from our database.
High Five lab reserves the right to revise or update this Policy if our practices change or as we change existing services, add new services or develop better ways to inform you of services we think will interest you, in our sole discretion. If we make any material changes, we will notify you by email (sent to the e-mail address specified in your account) or by means of a notice on our website.

8. Children’s Privacy
High Five lab does not solicit or knowingly collect Personal Information from children under the age of 13. If High Five lab obtains actual knowledge that it has collected Personal Information from a child under the age of 13, High Five lab will immediately delete such information from its database. Because High Five lab does not collect Personal Information from children under the age of 13, High Five lab has no such information to use or disclose to third parties. High Five lab has designed this Privacy Policy to comply with the Children’s Online Privacy Protection Act (“COPPA”).

9. Information Collection Practices.
9.1.      Traffic Data. Like most website and mobile application operators, High Five lab automatically gathers information that web browsers automatically make available, including: (i) IP addresses; (ii) Internet domain names; (iii) types of devices accessing the Service; and (iv) types of Web browsers accessing the Service (collectively “Traffic Data“). Traffic Data is anonymous information that is not meant to personally identify you.
9.2.      Cookie Policy. “Cookies” are text files that are placed on your computer by websites that you visit or certain emails that you open. Cookies store a string of information on a user’s computer or mobile device, which the user’s web browser provides to the Service automatically each time it interacts with the Service. The purpose of Cookies is to identify the user as a unique user of the Service. High Five lab uses two types of Cookies: “first-party cookies” and “third-party cookies.”
9.3.      First Party Cookies. High Five lab uses first-party Cookies on the Service, for example the Google Analytics Cookie, for the following purposes: (1) to gather visitor and access information relevant to customizing the Service to your interests; and (2) to store your password so you do not have to re-enter it each time you use the Service.
9.4.      If you do not wish to have first-party Cookies placed on your computer or mobile device, you should set your web browser to refuse Cookies before accessing the Service. However, certain features of the Service may not function properly without the aid of Cookies. If you refuse Cookies, you assume all responsibility for any resulting loss of functionality.
9.5.      Third Party Cookies and Advertising.
9.5.1.   Advertising on Third Party Websites. High Five lab may advertise on other Third Party Websites to you after you access the Service. We and third-party marketing partners, including without limitation Google, Inc. (“Google“), may use first party Cookies (such as the Google Analytics cookie), third party Cookies (such as the DoubleClick cookie), and web beacons (such as the Facebook conversion tracking pixel, see https://www.facebook.com/business/a/online-sales/conversion-tracking), including across multiple devices, to inform, optimize, and serve advertisements to you based on your use of the Service. This practice is commonly known as retargeting or remarketing (see https://en.wikipedia.org/wiki/Behavioral_retargeting).
9.5.2.   Google Analytics.
9.5.2.1.  Google Analytics is Google’s analytics tool that helps website and app owners to understand how their visitors engage with their properties. It may use a set of cookies to collect information and report website usage statistics without personally identifying individual visitors to Google. The main cookie used by Google Analytics is the “__ga” cookie. High Five lab uses Google Analytics on the High Five lab website.
9.5.3.   Data Collection by Third Parties. Any of these third parties may place Cookies on your computer or mobile device, use web beacons (see https://en.wikipedia.org/wiki/Web_beacon), and gather IP addresses and log data to collect traffic and activity data to deliver relevant metrics and content.
9.5.4.   Opting Out of Third Party Cookies.
9.5.4.1.   You may customize your Google Cookies preferences or opt out of using Google Cookies on the Google Ads Settings page at http://www.google.com/settings/ads.
9.5.4.2. You may learn about Facebook Cookies and how to customize your preferences at https://www.facebook.com/about/ads.
9.5.4.3.            You may opt out of using other third parties’ Cookies by visiting the Network Advertising Initiative opt-out page at http://www.networkadvertising.org/managing/opt_out.asp. You can also learn more about how to delete or control Cookies at http://www.aboutcookies.org/.
9.6.      Personally Identifiable Information. To use certain features of the Service, you will be asked to provide High Five lab certain personally identifiable information (“Personal Information“). Personal Information includes the following categories, without limitation: (1) “Contact Data” (such as your name, phone number, fax number, mailing address and email address); (2) “Financial Data” (such as your credit/debit card number and expiration date); (3) “Demographic Data” (such as your gender and ZIP code); and (4) “Third Party Social Media Account Data” (such as your account information for third party social media accounts when you access the Service in connection to those accounts). In each case, you will be asked to provide Personal Information; the Service will not gather it secretly. High Five lab may supplement the Personal Information you provide with additional Personal Information gathered from public sources or from third parties (e.g., consumer reporting agencies) who may lawfully provide that information to High Five lab. You are under no obligation to provide Personal Information, with the caveat that your refusal to do so may prevent you from using certain features of the Service.
9.7.      Specific Information Collected. High Five lab collects the following specific items of Personal Information:
9.7.1.   your first and last name
9.7.2.   your address
9.7.3.   your email address
9.7.4.   your telephone number
9.7.5.   information about your employer
9.7.6.   demographic information (which is stored only in aggregate, and is not linked with your account)
9.7.7.   information to connect to your accounts with third party services, if you opt to use High Five lab’s third party integrations (see Section 1.4 (Separate Terms of Service))
9.8.      Information You Make Public. The Service may contain features (e.g., email, instant messages, electronic messaging, etc.) that allow you to upload, post, transmit, display, perform, or distribute content, or other information, including your Personal Information. Any information that you choose to disclose by means of such features becomes public information over which High Five lab is unable to exercise control. You should exercise caution when deciding to disclose your Personal Information by means of such features, and you agree to assume all responsibility for doing so. (Defense Attorney)
